A provisional patent application is one of the smartest tools an inventor can use. Experienced innovators know it is smart to focus their efforts and finances on marketing instead of speculating on filing expensive, permanent patent applications. Provisional applications only cost $110 to file.

Do it right. Use the same legal format with the same types of drawings as the permanent patent application, but without the legal claims.
- Once filed they are kept at the PTO for one year, establishing a legal filing date.
- They are not examined by the PTO.
- During the year you have patent pending status.
- Prior to the end of one year, the permanent patent application is filed referencing the provisional patent application.
- Provisional patent applications effectively preserve your right to file patent applications internationally providing there was no public disclosure prior to filing.
Writing provisional patent applications
We have seen several terrible, absolutely worthless, provisional patent applications written by patent mills. Don't fall into that trap.
