A provisional patent application costs less than $125 to file and is one of the smartest tools an inventor can use. Experienced innovators know it is wise to focus their efforts and spend their money on qualifying marketability instead of speculating on expensive permanent patent applications that costs $5000 or more. After all, you want to make money, not spend it.

Here's are the details:

  1. They are the same legal format with the same kind of drawings as the permanent patent application, but without the claims.
  2. Once filed they are kept at the PTO for one year, establishing a legal filing date.
  3. They are not examined by the PTO.
  4. During that year you have patent pending status.
  5. Prior to the end of one year, the permanent patent application must be filed referencing the provisional patent application.
  6. Provisional patent applications effectively preserve your right to file patent applications internationally providing there was no public disclosure prior to filing.
  7. Filing fees are $100 for a small entity, $200 for large.

How to write provisional patent applications
Experienced inventors who have done a thorough patent search usually write their own applications by modeling after one of the patents found while patent searching. Many also use the software PatentWizard that'll help write it in just a few hours in the proper legal format.

If you're inexperienced with patent writing it is important to follow a book such as From Patent to Profit, or PatentWriter (spring 2006) that uses the most up to date format and terminology to maximize protection. It may sound strange, but it's true, most patent writing books do not reflect today's laws and recent court cases such as Phillips vs. AHW.

Once you have written your application, your patent attorney or agent can review and edit it.
